Overtime Compensation

Hourly (nonexempt) employees are covered by the Fair Labor Standards Act (FLSA). Faculty and salaried (exempt) employees are not covered by the FLSA.

Overtime requires prior approval from the Supervisor. Hours worked in excess of thirty-nine (39), the standard Cornell work week, are paid as follows: The first hour is paid as straight time and a premium rate, i.e. time and one-half (1.5), is paid for hours worked in excess of forty (40). This applies to all nonexempt hourly-paid staff members whose employment status is regular full-, part-time or temporary. All nonexempt staff members are subject to the overtime pay provisions of the FLSA and must be compensated for all hours worked.
